By using this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together, with our privacy policy, govern Yapico’s relationship with you in relation to this website and our construction and maintenance services.


I. Site Usage

The content found on this website is for your general information and use only. It is subject to change without notice. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose.

You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable.

It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements. This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics.

Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offense. From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s).

I. Hosting

There are no set limits on the disk space or data transfer (bandwidth) that we provide in our hosting plans. We want you to have the resources you need to build a great online presence, and 99.95% of all customers will have more than enough disk space and bandwidth to meet their needs.

That being said, we do require all customers to be fully compliant with our Terms of Service and utilise disk space and bandwidth in the normal operation of a personal or small business website. While it is rare, we may need to put constraints on accounts that are using resources beyond what would be expected in the normal operation of a personal or small business website.

Typically, customers only run into issues if they use their accounts for storage or file sharing, which is not what our services are intended to support. In accordance with our Terms of Services the disk space and bandwidth you use must be integrated into the normal operation of your website. 99.95% of our customers fall into “normal” range.

Typically, customers who fall outside the normal range are using their accounts for file storage or sharing rather than hosting, which is a direct violation of our Terms of Services. If you have a question about whether your website will fall into the normal range, feel free to contact our team.

We’ll be happy to talk about your specific needs before you purchase your hosting plan. If you exceed “normal” usage, you will receive an email asking you to reduce usage. Generally, we provide customers with a minimum of 48 hours to make adjustments before taking the account offline.

Again, the most common situations involve customers who use their accounts for storage of files (particularly multimedia files) that are not linked off of their websites. It is very rare for a customer who is managing a personal or small business website to exceed normal usage.

In addition to this, each individual mailbox has a storage capacity of 250MB. (Note: This does not count Microsoft Exchange accounts which are hosted separately.)

II. Content

In most cases, the client will provide Yapico with all content to be posted on to the website, unless otherwise stipulated during the planning phase. This content will include both written and visual content (such as – but not limited to – pictures, logos or photographs).

By sending said content to Yapico, you are stating that you have sole proprietorship over all items used on the website, and any subsequent legal issues that may arise from the misuse of content rests solely with the client, and not Yapico.

Furthermore, Yapico will not use images of a graphic or adult nature, and reserve the right to reject any website additions that feature such content. The client is free to withdraw from our services with this knowledge.

III. Deposits

All sites require an existing domain name to build the site. This must be purchased by the client beforehand, either individually or through Yapico’s services. Likewise, any initial outlay that is needed before the building work begins must be pre-purchased by the client.

This will be explicitly stated by Yapico beforehand. Lastly, a deposit of between 25% – 50% may be required before building to cover additional, unforeseen costs and labour. This deposit is refundable with the exception of costs outlaid for materials and domains if Yapico’s services do not meet the client’s expectations. (Please see our refund policy below for more details).

IV. Maintenance Services

Yapico agrees to fulfill the subscription services listed in any subscription plan chosen on our plans and pricing page. Yapico reserves the right to change any of these services at any time with notification to any client who is under said plan.

Users have the right to cancel any subscription service at any time without any fees if they feel the updated service does not meet their needs, at which point Yapico will cease to provide said services. Yapico cannot continue to host websites that are not under a maintenance plan subscription with Yapico’s services.

It will be the responsibility of the client to find suitable hosting to house their website. There may be a fee for migration from Yapico’s hosting services to your new host. Please contact your site administrator.

V. Construction Services

Your website will be designed by one of our web developers who will do their best to deliver you the website you envision at a cost that you can afford. We are confident that when you choose Yapico as your website construction company, you will be a satisfied customer.

To ensure your complete satisfaction we will build your site under our domain (on a unique subdomain) allowing you access to each and every page. We can do so hidden from public view if requested. This empowers you by giving you the ability to offer creative feedback and input regarding the changes that you desire from the comfort of your home or office.

We will work with you step-by-step through the development process to ensure the site is meeting your expressed needs and exceeding your expectations. Once we have mutually agreed that the site is finished and ready to publish – then, and only then, are you obligated to pay us the balance for our web development services.

Once we have received payment we will release access to your domain. If you have chosen to host the website by yourself Yapico will require full access to your host account so as to complete our services.

If Yapico will no longer be your webmaster, once construction is complete, Yapico promises to destroy all host account records originally provided by client. It is recommended that the user changes their password at this time.


I. Overview

Our goal is to provide high quality, professional service to all of our clients. If you’re not satisfied with the progression of your new website design, we offer a refund guarantee on the advance paid for services.

Our refund policy works as below: 100% refund of payment for services, if requested prior to showing of any design layout, no questions asked, or before the 2nd round of revision request.

II. Restrictions

Refund is not allowed once two rounds of revisions are requested
Refund must be requested within 15 calendar days from date of original order
Refund not applicable on domain registration fees and design purchases made exclusive to your website
Refunds are not available on maintenance services
Refund must be requested in writing
Refund not applicable on updates and add-ons on existing website

Your acceptance of these terms

By using our services you signify your acceptance of our terms. If you do not agree to these terms, please do not use our services. Your continued use of our services following the posting of changes to these terms will be deemed your acceptance of those changes.
